日本法科大学院制度的失败与经验 *

The Failure and Experience of Law School System in Japan

摘要:

法科大学院制度是在日本司法制度改革的背景下,以美国法学院为参照对象,试图通过快速高效重实务的教育模式,培养出具有广泛学科背景的司法人才教育制度。经过十几年的实践检验,日本法科大学院制度呈现出招生人数断崖、大量法科大学院被迫关闭的现实情况,并进一步引发了日本国内律师职业共同体弱化、学生质量与法学教研水平下降等问题。对实践与国情的不尊重,偏离教育规律的司法改革理念是造成日本法科大学院制度失败的根本原因。为此,我国法治人才培养需要吸取日本的经验,在理论层面确立正确的法治人才培养理论,在实践层面坚持符合我国国情的中国特色社会主义法治人才培养制度、在强调顶层设计的同时重视基层实践的探索与经验总结、平衡好法学基础理论知识与实践知识在教学中的关系,进而打造符合中国实践需要的法治人才队伍。

Abstract:

The law school system in Japan is based on the reform of Japanese judicial system with American law school as a reference object, which attempts to cultivate judicial personnel with a wide range of disciplines through a fast and efficient model. After more than a decade of practical tests, the system had shown an enrollment plummets, and a large number of law schools had been forced to close. These had caused problems such as the weakening of the Japanese lawyers’ professional community, the decline in student quality and the level of law teaching and research. And the disrespect for practice and national conditions as well as the idea of judicial reform deviating from the law of education are the root causes of the failure of Japanese law school system. Therefore, China’s judicial personnel training model needs to learn from Japanese experience, which includes establishing the correct theory of legal personnel training at the theoretical level, and adhering to the socialist judicial talents training system with Chinese characteristics in accordance with China’ s national conditions at the practical level. While emphasizing the top-level design, it is also necessary to attach importance to the exploration and experience summary of grass-roots practice, and to balance the relationship between the basic theories of law and practical knowledge in teaching, which are also vital for building a judicial personnel team in line with China’s practical needs.
