教育惩戒:价值、边界与规制(笔谈)

摘要:

近几十年来,在全世界范围内,教育惩戒开始成为一个大家普遍关注的问题,而且成为法律必须面对的问题。正确理解教育惩戒,区别教育惩戒与体罚,明确教育惩戒权的性质及教育惩戒权的行使主体是正确看待教育惩戒问题的前提和基础。要认识到教育惩戒问题的复杂性,坚守教育活动内在的逻辑,促进教育与法律之间的深层协作。羞耻与威慑是教育惩戒的逻辑,基于“羞耻”而唤醒内在自我“尊严”所实现的观念秩序维护,是严格意义上的实质性教育行动——以观念秩序自觉实现行为秩序自觉的自我教育。教育惩戒可以有效遏制学生过错行为,积极教育是治理学生过错行为的源头,积极管理则使纠错警示更具有针对性、及时性和灵活性,三者有机结合,比单一教育惩戒更有实效。教育惩戒的关键是教育效果,惩戒教育必须考虑受教育者的年龄特征、人格特点、性别差异,惩戒的具体方式不能越界。明确区分教师惩戒权和学校惩戒权,是制定教育惩戒权相关实施细则的前提和关键。教师教育惩戒权是对教育本质的回归,教师教育惩戒权具有权利和权力双重性质,也有其限度。高校教师应同样享有教育惩戒权。

Abstract:

In recent decades, educational punishment and discipline has become a common concern as well as a legal issue around the world. Correctly understanding educational punishment and discipline, distinguishing it from corporal punishment, and clarifying the nature of the right of educational punishment and discipline along with the right of the exerciser are the premise and basis for correctly treating the problem of educational punishment and discipline. It is necessary to recognize the complexity of the issue of educational punishment and discipline, adhere to the inherent logic of educational activities, and promote the deep collaboration between education and law. Shame and deterrence are the logic of educational punishment and discipline. The maintenance of the conceptual order realized by “shame” to awaken the inner self “dignity” is a substantive educational action in the strict sense of the self-consciously implementing behavioral order with the conceptual order. Educational punishment and discipline can effectively curb student's faulty behavior. Active education is the source of managing student's faulty behavior. Active management makes error correction warnings more targeted, timely and flexible. However, the combined use of the three would be more effective than a single use of educational punishment and discipline. The key to educational punishment and discipline is the educational effect. Therefore, it must take students’ age characteristics, personality characteristics and gender differences into consideration. A clear distinction between teachers' right and schools' right of educational punishment and discipline is the premise and key to formulating relevant implementation rules. Teachers’ right of educational punishment and discipline is the return to the nature of education. And it has a dual nature of right and power, as well as its boundaries. College teachers should also be entitled with the right of educational punishment and discipline.
